IT Support for LGD Compliance

The General Law on the Rights of Persons with Disabilities and their Social Inclusion (Real Decreto Legislativo 1/2013) establishes that public or private companies with 50 or more employees must reserve at least 2% of their workforce for people with a recognised disability of 33% or more.

When it is not possible to meet this quota due to organisational or productive causes, the regulations allow applying alternative measures, such as contracting services from Special Employment Centres, making donations to foundations linked to disability, or formalising commercial contracts with professionals with disabilities.

LEGAL FRAMEWORK

Real Decreto Legislativo 1/2013

Spain's General Disability Law (Ley General de Discapacidad) consolidates disability rights legislation and establishes employment obligations for companies. It is enforced by the Labour and Social Security Inspectorate.

THRESHOLD

50 or more employees

As soon as your total workforce — including permanent and temporary contracts — reaches 50 people, the obligation activates. This threshold is calculated on a rolling 12-month average, not just at a point in time.

OBLIGATIONS

2% workforce quota

At least 2% of your total active employees must have an officially recognised disability (equal to or above 33%). This quota applies to the general workforce, not just new hires.

LEGAL EXCEPTION

Alternative measures

When direct hiring is not feasible (justified by market conditions, professional profile unavailability, or organisational reasons), the law allows alternative measures: service or supply contracts with Special Employment Centres (CEE), or donations to foundations promoting disability employment. These must be formally documented and renewed annually.
